Terms of Use – Legal Notice and General Contract Conditions

1. Scope of application and subject of the contract

1.1. These General Contract Conditions govern the relationship between the guesthouse La Casa di Benedetta (hereinafter “CB”) and the Customer regarding the provision of accommodation services selected by the Customer in the booking proposal, chosen among those offered by the property and available on the website lacasadibenedetta.com. 1.2. The Customer may request the provision of services by submitting a booking proposal to CB through: email to info@lacasadibenedetta.com ; telephone, verbally, by calling +39 333 5823692; the online booking procedure available on the website. 1.3. The contract is considered concluded when the Customer submits the booking proposal in one of the ways indicated in point 1.2 and communicates it to CB. The effective conclusion of the contract is always subject to service availability. Confirmation is provided by CB upon receipt of the proposal or shortly thereafter. 1.4. If the activation of the services cannot take place due to causes not attributable to CB, the contract shall be automatically terminated without any liability on the part of CB towards the Customer. 2. Activation and provision of the service 2.1. Upon activation of the service, CB guarantees the Customer: the use of furnished accommodation units (hereinafter “Rooms”), in the number and type specified in the booking proposal; internet connection, weekly room refresh and linen change, and all services required by current regional legislation governing guesthouses. 2.2. CB shall provide the Customer, on loan for use, with any additional equipment necessary for the full enjoyment of the selected services (keys, cards, etc.). 2.3. The Customer must use the Rooms, common areas, and equipment in a manner that does not disturb the regular operation of the service or other guests. The Customer shall be solely responsible for any direct damage resulting from a breach of this obligation and shall hold CB harmless from any consequence, cost, or charge. 2.4. The Customer shall indemnify and hold CB harmless from any damage, liability, expense (including legal costs), or claims made by third parties arising from acts or omissions attributable to the Customer or resulting from non-compliance with these General Contract Conditions. 3. Booking and payment 3.1. In the case of bookings for a future date, CB may require advance payment of the amount due. 3.2. Failure to pay within the established time limits shall result in cancellation of the booking without the need for any notice from CB. 4. Duration of the contract, cancellations, and penalties 4.1. The contract is valid and effective from the date of conclusion and shall terminate once both of the following conditions are met: the Customer and any related third parties have definitively vacated the accommodation; the Customer has paid the full amount due to CB. 4.2. Check-in is available between 4:00 PM and 7:00 PM. Access to the entire property before this time is not permitted. Any arrivals outside these hours must be agreed in advance with CB. Failure to provide prior notice may cause issues not attributable to CB. Self check-in is also possible, including after the scheduled check-in time, but never before 4:00 PM. For self check-in, the Customer must arrange this with CB. Check-out must strictly take place by 10:00 AM. Failure to do so will result in the charge of an additional night. 4.3. The Customer may cancel the booking and terminate the contract within the time limits referred to in point 3.1. No refunds are provided for guests who leave CB early, regardless of the reason. 5. Privacy protection 5.1. Pursuant to Article 13 of Legislative Decree no. 196/2003, the Customer is informed that the processing of personal data provided to CB is necessary to enable the property, directly or through third parties, to fulfill obligations arising from this contract or from laws and regulations. 5.2. The data controller is the legal representative of CB. 6. Identification documents 6.1. Upon arrival, valid identification documents (passport or ID card) must be provided for registration in accordance with current regulations. Failure to comply constitutes a violation of the Criminal Code and authorizes CB to request immediate departure from the property. Guest data is processed in compliance with current privacy regulations. 7. Liability 7.1. CB shall be liable for contractual non-performance and service provision only for causes directly attributable to CB. 7.2. If, upon arrival, the Customer finds a service different from the one agreed but accepts it nonetheless, the Customer shall be deemed to have waived any claim for compensation, and the new service shall replace the previously agreed one by mutual consent. 8. Limits of liability 8.1. CB shall not be liable for delays, inconveniences, malfunctions, or interruptions of the service due to: force majeure or unforeseeable circumstances; tampering or interventions carried out by the Customer or unauthorized third parties; damage or inconvenience caused by partial or total interruption of electricity or water supply. CB is not responsible for valuables brought into the property by guests. 9. Management recommendations 9.1. Silence / Children Total silence must be observed from 11:00 PM to 8:00 AM and from 2:00 PM to 4:00 PM, both in rooms and common areas. Children must always be accompanied by an adult. Guests must behave in a manner that does not disturb others at any time. 9.2. Cleaning Room cleaning is not daily. If required, it must be arranged with CB, which will provide a quotation. Rooms must be vacated for cleaning between 10:00 AM and 1:00 PM. If rooms are not vacated during this time, cleaning will be postponed to the following day. Guests are kindly requested to arrange personal belongings to allow cleaning. 9.3. Other guests It is strictly forbidden to introduce unauthorized persons into rooms, terraces, or any area of the property without the manager’s consent. Penalty: €250.00. Subletting or lending the room, in whole or in part, is prohibited and will result in cancellation of the booking and a €250.00 penalty. 9.4. Breakfast The property does not provide breakfast, as it is a guesthouse. Each room is equipped with a minibar for guest use, free of charge. 9.5. Smoking / Weapons / Drugs It is strictly forbidden to bring weapons, drugs, or similar substances into the property. Violation will result in immediate termination of the contract. Smoking is strictly prohibited inside the rooms. Smoking is allowed on the terrace only, using the ashtrays provided. 9.6. Personal belongings No personal items may be left in corridors or common areas. CB is not responsible for unattended personal belongings. CB declines all responsibility for loss, theft, or damage of personal items left unattended in rooms. 9.8. Pets Pets of any kind or size are strictly prohibited on the premises. 9.9. Decorum It is strictly forbidden to move around the property wearing clothing that may offend public decency. Guests are prohibited from engaging in behavior that may disturb other residents of the building. 9.10. Bathrooms Guests are requested to use bathroom facilities properly and civilly, avoiding disposal of any objects in the toilet (use the appropriate waste bins).
